El procedimiento administrativo sancionador de la Función Judicial, ¿Es garante de derechos?

Al referirse a sanciones administrativas, nos referimos al ius puniendi del Estado, que recae sobre los órganos administrativos del mismo. La constitución es la norma reguladora de los límites del mencionado ius puniendi o poder punitivo, estos límites pueden versar dentro de las garantías constitucionales de incidencia procesal siempre y cuando sean susceptibles de aplicación dentro de los procedimientos administrativos sancionatorios. De tal manera que la finalidad es determinar si las garantías procesales consagradas en la constitución son susceptibles de ser aplicadas, en el ámbito del derecho administrativo, tomando en cuenta que dentro del procedimiento administrativo sancionador, la norma jurídica es el medio (texto normativo) y el fin (derecho protegido), de la actividad de los entes públicos.

Abstract:

When referring to administrative sanctions, we refer to the ius puniendi of the State, which falls on the administrative organs of the same. The constitution is the rule regulating the limits of the aforementioned punishment ius puniendi or punitive power, these limits can be within the constitutional guarantees of procedural incidence as long as they are susceptible of application within the administrative sanctioning procedures. In such a way that the purpose is to determine if the procedural guarantees enshrined in the constitution are capable of being applied, within the scope of administrative law, taking into account that within the administrative sanctioning procedure, the legal norm is the medium (normative text) and the end (right protected) of the activity of public bodies.
